Careful death benefit planning is an essential part of any prudent estate plan. Thorough planning now could potentially avoid costly mistakes later. This session examines various super death benefits strategies in light of the reforms, including:

  • Making a binding death benefit nomination v death benefit pension
  • Understanding the changes to death benefit cashing rules
  • Options available to the beneficiary to stay under the transfer balance cap
  • Directing death benefits to the estate and using testamentary trusts
  • Case update, including Cantor Management v Booth [2017] SASCFC 122

Kylie is a partner in the Corporate and Commercial Group. She is an experienced succession planning law expert and an SMSF Association Accredited SMSF Specialist Advisor.
