What is more important with estate planning – the family or the tax issues?  This session will examine the critical need to strike a balance between the needs of different branches of the same family and the tax and stamp duty implications arising from the reorganization of assets pre and post death.  This session covers:

  • Testamentary arrangements to transfer family businesses to perpetual trusts - what are the tax & duty implications?
  • Umbrella or master trusts to provide control of family trust groups -  are there any tax traps?
  • Use of SA perpetual trusts to stream Australian income to Australian family members, and foreign income (tax free) to foreign beneficiaries - what are the benefits?
  • Trust splitting to give control over specific trust assets to specific family members
  • Trust splitting to divide control of single asset for separate family members - what are the tax and duty consequences?

Edward Skilton, Special Counsel, Sladen Legal, Melbourne 

Edward has particular expertise in relation to the succession problems faced by high net worth individuals and private business owners, including issues relating to control of entities, a fair and equitable division of wealth, and resolving disputes between family members.

Edward brings a collaborative approach to solving client problems, often with other lawyers and in conjunction with the client’s accountant, financial adviser and banker. 

Edward also writes for professional publications and presents seminars for clients, lawyers and other professionals on the subject of how to structure estate and business succession plans to avoid disputes and protect assets for future generations.
