  • Alternatives in making testamentary trusts optional
  • Trustees – who?
  • What powers do the trustees need?
  • Beneficiaries – how to define the beneficiary class?
  • Appointor/guardian or none?
  • If so, what powers?  What veto rights?
  • Term of trust – defined short term or maximum possible?
  • When not to use testamentary trusts
