Drafting water tight financial agreements requires careful attention to key details, and making the agreement capable of withstanding a challenge. While the High Court in Thorne v Kennedy may have made it harder to draft water-tight agreements, it’s certainly not impossible. Drafting tips on making financial agreements binding and enforceable is examined in this session, including:

  • Preliminary drafting issues – broad definitions and time stipulations
  • Essential drafting elements of binding financial agreements
  • Key inclusions: key recitals, property settlement, children, insurance, cash settlement, maintenance
  • Avoiding unnecessary complications - what can safely be excluded
  • Recognising jointly held property – ensuring equitable treatment
