This webinar comprises 3 one-hour sessions covering each of the compulsory CPD subjects for commercial lawyers for the CPD year ending 31 March 2019.
 

Session 1: Legal Ethics:  A Day in the Life of an Ethical Litigator

On any given day, the duties of a litigation lawyer are going to be tested and stretched.  This session looks at your overriding duties to the court and works through some tricky situations you may encounter. It covers:

  • 7am – walking to work with the umbrella of your duty to the Court;
  • 9am – finalising a pleading and you have doubts – where do you draw the line?
  • 11am – signing the list of documents. Have we discharged our duty?
  • 1pm – receiving privileged documents from the other party. What to do?
  • 3pm – the file review and the UCPR
  • 5pm – are you going to get a costs order against your firm?


Session 2: Professional Skills: The ‘Concise Statement’ – Drafting to Meet Federal Court Requirements

Federal Court rules on the initiating and responding ‘Concise Statement’ place extra pressure on practitioners to get their drafting in order.

This session looks at key issues in drafting the Concise Statement, including:

  • Use of the Concise Statement - form and content
  • Narrative drafting and the challenge of brevity – drafting like a pleading summons
  • Setting out the facts giving rise to the claim – being ‘plain concise and direct’
  • Drafting the relief sought
  • Primary grounds for relief and alleged harm suffered by applicant
  • The Court Rules – the Commercial and Corporations Practice Note
  • Case study – an example of a Concise Statement in a federal matter


Session 3:  Practice Management & Business Skills:  Defending your Mental Health: Managing Wellbeing in Legal Practice

One in five Australians will be affected by mental illness. And the statistics are even higher for those in the legal profession. This session examines how to best support employees experiencing mental health issues, whilst also managing the impact is has on your practice. It covers:

  • Prevalence of mental illness
  • Why mental health is important for lawyers
  • Supporting colleagues with mental illness – best practice fundamentals
  • Identifying the stressors within the profession and what can be done to mitigate these, including:
    • encouraging work / life balance and flexibility
    • resilience training
    • managing competing priorities
    • dealing with time pressures, difficult clients and adversity
  • Managing the impact of mental illness in the workplace 
  • Providing access to resources available to assist

Chris Hargreaves, Special Counsel, Batch Mewing Lawyers, Brisbane

With more than 15 years experience in dispute resolution, Chris provides practical, commercial and business driven advice. As a senior lawyer, Chris’ primary role at Batch Mewing is to offer supervision and mentoring to the team, with a particular focus on litigation, insolvency and securities matters as they arise. Chris supports our lawyers and clients with a strong technical knowledge combined with the ability to simplify complex tasks and issues.

With extensive commercial experience and as a business owner himself, Chris’ advice is always focused on seeing that our clients’ broader interests are considered as part of any legal matter that might arise.

Maya Rozner, Barrister, Melbourne

Maya has over 20 years’ experience at the commercial bar appearing in applications, directions and trials in jurisdictions from VCAT to the Supreme Court of Appeal.

She enjoys a broad based commercial practice including contract disputes, equities, trusts, partnerships, mortgages and other securities as well as property disputes, building and construction, franchise disputes, company and insolvency disputes. Maya has also appeared in Fair Work Act general protection and unfair dismissal matters as well as discrimination and equal opportunity matters in the Federal Court and VCAT.

Maya completed her Australian Mediation Training in 2004. She is an accomplished and strategic negotiator and will provide early assistance to instructors and clients on limiting the costs and risks of lengty6 and expensive trials where appropriate. She has successfully employed the Civil Procedure Act 2010 to enforce procedural compliance by opposing parties in disputed matters including on matters of costs.

Mark Howard, Partner, HWL Ebsworth, Melbourne

Mark Howard is the National Practice Group Leader in the Workplace Relations and Safety Group.

Mark has more than 25 years experience in industrial relations and employment law. He specialises in providing advice to large corporate clients and statutory authorities and has a range and depth of experience across a broad range of industries, including government, building and construction, retail, manufacturing, financial services, insurance, technology and energy and resources.

Mark's practice focuses on enterprise bargaining and workplace agreements, dispute resolution, business restructures, board and executive solutions and compliance and risk management. He also has experience in designing and delivering training programs for use by employers and regularly presents at seminars and conferences.
