 ABOUT THE WEBINAR
When hiring employees to meet labour demands, a critical consideration is determining the right employment type: permanent, casual, fixed term or maximum term. This session will set you straight on the definitions of the different employment types, and have you thinking about the risks associated with miscategorising the employment relationship. Matters covered include:

  • Common law and workplace instrument definitions of employment types:

    • full time

    • part time

    • casual

    • fixed term

    • maximum term

  • Operational considerations - what is the right type for your business’s needs?

  • Legal risks of miscategorising employees, particularly casuals who are not really casuals

  • When casual conversion is required by Awards

  • Legal risks associated with term contracts, with reference to case law including Saeid Khayam v Navitas English Pty Ltd [2017] FWCFB 5162

Our presenter

Nick Ruskin, Partner, K&L Gates, Melbourne

Mr Ruskin practises in labour relations and employment law. He represents corporations in a number of industries including energy, retail, services and healthcare, and public sector clients in the health, higher education, government and community sectors.

He has extensive experience in labour disputes, employment claims, anti-discrimination issues, legislative compliance, advocacy before tribunals and providing forthright, practical advice to clients.

He has been engaged from time to time as an external consultant to the International Labour Organisation (ILO) in Geneva, New York and Bangkok & has addressed an ILO forum at the United Nations on Australian labour standards.

He is active in human resources circles through his role as convenor of the employee relations committee of the Australian Human Resources Institute (Victoria) and is a regular speaker and commentator at professional conferences on labour relations law.

He is a member of the Legal Profession Reference Group, an advisory body to the President of the Fair Work Commission, Justice IJK Ross. Mr Ruskin is ranked as one of Australia's leading labour and employment lawyers by Chambers Global, Chambers Asia Pacific, Best Lawyers, PLC Which Lawyer? and the Guide to the World's Leading Labour and Employment Lawyers.
