This session looks at how to clean up the deceased’s tax issues when there are outstanding liabilities and loans. Understanding the tax implications of debt forgiveness and outstanding liabilities is the focus of this session, and includes:

  • What happens with debt forgiveness if shareholder dies?
  • What happens with Div 7A loans if debtor dies?
  • Can you forgive the debt without any consequences?
  • Understanding the CGT issues for the trust where it is given a benefit for no return
  • Commercial debt forgiveness – impact on capital losses
  • Liability for unpaid super guarantee payments and PAYG
  • Navigating the hurdles – use of private rulings, internal audits and other practical solutions
