 ABOUT THE WEBINAR
The second time around, individuals are often a little more savvy.  Getting their financial affairs in order and understanding the long term impacts are a high priority for the individuals and a complicated exercise for lawyers and estate planners.  This session covers the mechanics of binding financial agreements in second relationships.  It includes:

  • Financial agreements when the scenarios are not straight forward:
    • contributions of collateral and income
    • how do you quantify what the parties are bringing to the table?
  • Children in second relationships – what considerations do lawyers need to have when drafting BFAs?
  • A failure to disclose – what is the effect of failing to disclose financial information or a change in circumstances?
  • When can a BFA be set aside in blended family?
  • Is the financial agreement enough? Considering other options:
    • family agreements and family conferences
  • Interplay between wills and BFAs:
    • what is the effect of referring to a BFA in a will?
    • what happens if the BFA is set aside?
    • lump sum payments referred to in both the BFA and the will – are you double dipping into the asset pool?
  • The legislative framework – where do we stand after the lapse of Family Law Amendment (Financial Agreements and Other Measures) Bill 2015?

Our presenter

Stephen Bourke, Director, SuperSplitting, Canberra

Stephen is the former head of the Family Law Division of the Commonwealth Attorney-General’s Department. He was project leader for the legislative amendments on superannuation and family law.

Stephen is author of the leading text on the subject of superannuation splitting Super Splitting for Family Lawyers published in 2011 and is an active member of the SMSF Association.

Stephen appears in court as a expert witness in complex superannuation matters as well as providing strategic or technical advice to parties that are negotiating settlement or collaborating.

Stephen is often invited to speak at conferences and seminars including the Biennial National Family Law Conference and Law Council of Australia Family Law Section Roadshows.
