Binding financial agreements can be a useful tool with second spouses in order to secure the blended family estate. However, despite involving considerable time, effort and expense, one or both parties will often refuse to sign on the dotted line. This practical session looks at what you can do to ensure you can get BFAs to work for your client and covers:

  • Which types of clients would benefit from a prenup financial agreement? Which clients are more likely to come to an agreement?
    • the younger spouse with children
    • two older spouses both with families from first relationships
  • What needs to be in each type of agreement?
  • Managing client expectations regarding financial agreements
  • How can you make a financial agreement work in a blended family scenario?
  • Drafting hot spots in the agreement to consider:
    • children (future and current)
    • future illness or affairs
    • aged care needs
    • divulging of assets
  • Making BFAs adaptable to changing circumstances
