The 2018 Facebook-Cambridge Analytica saga has shone a glaring spotlight on the inappropriate use of data harvesting. This session examines the obligations on SMEs to protect private data in the context of Australia’s new mandatory data reporting regime, as well as the recently implemented EU data protection regime. It covers:

  • Legal obligations relating to the protection of data in the new regulatory landscape
  • Understanding the data breach reporting obligations
  • Liability for data breaches
  • Ensuring clients have the right infrastructure and procedures in place to ensure data integrity

Andrew Shute, Partner, Carter Newell Lawyers, Brisbane

Andrew Shute is a Partner in the Litigation & Dispute Resolution team.

Andrew has more than 20 years experience in commercial litigation and alternative dispute resolution, advising a wide variety of public and private sector clients on complex disputes, and strategies for their conduct and resolution.

Andrew's recent focus has been on disputes involving the resources and energy, commercial property and leasing, and financial services industries.  He also has significant experience in defamation, having previously advised a commercial broadcaster for more than seven years.

Andrew is well placed to assist clients to identify and manage business risks, and to deal with challenging situations. He is recognised for his skills in reviewing, interpreting and drafting contractual and statutory provisions, and in developing information management strategies in dispute and non-dispute contexts (including advice in respect of e-discovery, subpoenas, privilege, confidentiality, freedom of information, and privacy issues).

Andrew also brings significant expertise in the use of technology in litigation to deliver efficient and cost effective outcomes for clients.  He is a member and past-Chair of the Association of Legal Support Managers, Queensland, a member of the Litigation Rules Section of the Queensland Law Society.  In addition, Andrew was a member of the Documents and Litigation sub-group of the Supreme Court of Queensland's Better Resolution Group.
