Recorded Webinar: Land Partitioning – Dealing with Unexpected State Tax Liabilities

25th October 2018

Duration:  approx. 1.5 hours

Land partitioning is not the same as subdivision and refers to land held jointly transferred to one or more co-owners. This session highlights some red flags on state tax liability on land partitioning, including:

  • The nature of land partition and its duty consequences
  • Determining dutiable value of partitioned land
  • Who is liable to pay duty?
  • No capital behind them – developments with neighbours
  • Anti-avoidance requirements pertaining to partitioning
  • Consolidated lots and partitioning – what is the duty position?
  • Operation of apparent purchaser provisions in legislation
