Construction of wills cases are a significant part of a succession lawyer’s practice. This practical session assumes you know the basics, and instead focuses on case study examples on how common law will construction rules apply in practice. It covers: 

  • Common law will construction rules – the tricky bits explained

  • How has this position been modified by statute?

  • Case studies:

    • Advancement to a real or potential beneficiary in a will

    • Avoiding ademption

    • Life interests v rights to reside

    • Joint tenants v tenants in common

  • Construction of will disputes – early effective resolution options

  • Ambiguous wills – when do you need to bring construction proceedings and when can you simply make a call on it?

  • Possible cost consequences of unnecessary applications

  • Recent construction cases

Caite Brewer, Barrister and Accredited Specialist (Succession), Brisbane

Caite has practised for nearly 25 years as both a barrister and a solicitor – more than 13 years exclusively in estate and trust litigation.

Caite has consistently been named one of Queensland’s ‘preeminent’ junior counsel in Estate Litigation in Doyle’s list since its inception in 2015. She is proudly also named one of the “preeminent” junior counsel in the whole of Australia in the National Doyle’s rankings in 2017 and 2018.

She is 1 of only 4 Queensland Law Society (QLS) accredited specialists in succession law at the Queensland Bar and was the highest achiever in her graduating year.

She is a member of Hemmant’s List and a regular presenter at seminars on wills, estates and trust law issues.

Her particular interests are in contentious probate matters, will construction and rectification cases informal will applications and superannuation disputes.

Live webinar delegates will receive a CPD certificate for attendance at this webinar.  Lawyers can claim up to 2 CPD units/points – substantive law.  This webinar has been designed to run for 2 hours, however, webinar lengths can vary depending on the level of questions and discussion, and the minimum length of the webinar is 1.5 hour.
