Digital assets present unique problems for will makers.  The issues arising from digital assets in estate matters have been the subject of much discussion among practitioners across the globe.  This session examines digital assets from a will construction perspective and how it impacts on the estate planning discussion with our clients and includes:

  • Digital assets – what are they and who owns what?
  • Understanding the types of questions you need to be asking your clients
  • Social media platforms – what happens when a member dies if there is no provision in the Will?
  • Dealing with problems of online accounts, such as access to passwords
  • Social media presences which have been commercialised and or have substantial value – e.g. twitter fees, Instagram accounts with substantial followings and so on - and does commercial value dissipate with death?
  • What to do with servers and accounts outside of jurisdiction?
  • Will drafting to deal with digital assets
  • Case study – model clauses for digital assets in Wills

Michele Davis, Associate, Bennett & Philp Lawyers, Brisbane

Michele Davis is a member of the Bennett & Philp Lawyers’ Wills and Estates Team.  A self-confessed succession nerd, Michele has a passion across all areas of wills, estates, succession and elder law.

Having dedicated her career to the study and practice of succession and elder law, Michele’s area of expertise include:  estate planning; estate administration ; trust establishment and administration; retirement villages and accommodation; guardianship; estate litigation and dispute resolution.

Michele received a Masters Degree in Applied Laws specialising in Wills & Estates and is a member of the Queensland Law Society’s Succession Law Committee.

Michele is also the founder of the successful Australian Succession & Elder Lawyers LinkedIn Group and writes regularly on case law in this practice area through her blog at www.micheledavis.com.au.
