After much reworking, the long-awaited and highly anticipated revised Commissioner’s Interpretation Statement for Public Benevolent Institutions has finally been released. The new Statement provides certainty for the charity sector, while opening the door to a wider variety of charities with differing activities that now may be eligible for PBI registration. This session will examine:

  • How organisations can comply - and prove compliance - with the new test of “organised, conducted or promoted”
  • The current position of the ACNC regarding sole purpose of benevolent relief
  • The circumstances in which ACNC considers a PBI may have a purpose of "advancing religion" and their implications.
  • Tips for how organisations can demonstrate their benevolent “characteristic and predominant purpose and activity”
  • How the statement deals with issues raised by the sector, including when and how organisations can charge for services, the impact of the statement on the ACNC’s interpretation of the PBI charity subtype, when (and how) organisations can engage in advocacy and the provision of benevolent relief through indirect means
  • Key recommendations from the Productivity Commission impacting PBIs
  • The impact of recent cases on the formulation of the final Statement

Dr Mark Fowler
Principal, Fowler Charity Law Pty Ltd Sydney, NSW

Dr Mark Fowler is a practicing lawyer whose specialist areas of advice include the law applying to schools, international aid organisations, arts and cultural organisations and religious organisations. Mark also has a breadth of experience in property and commercial law, with a particular focus on the affordable, community and social housing sectors. Mark has advised many leading national and international charities across these fields.

Prior to establishing Fowler Charity Law Pty Ltd, Mark was a Partner in leading national charity and not-for-profit law firms located in Sydney and Brisbane.

He is an Appeals Panel member for the Australian Council for International Development (ACFID), the peak body for Australian non-government organisations (NGOs) involved in international development and humanitarian action. He is a member of the Australian Charities and Not-for-Profits Commission Professional Advisory Group and has served as a member of the Queensland Law Society’s Human Rights Working Group. He is also an Adjunct Associate Professor at the University of Notre Dame Law School, Sydney and a Fellow of the Centre for Public, International and Comparative Law, University of Queensland. He holds a doctorate degree in law conferred by the University of Queensland in 2023.
