Session 1:  Property and Financial Matters under the new FCFCOA

A key reform of the new FCFCOA is the fast-tracking of property matters. But how does the pathway work and how have property matters been impacted by the court changes? This session examines what family lawyers need to do now to adapt to the new FCFCOA and how it will impact the way you manage property and financial matters in practice, including:

  • New case management pathway and the role of ADR
  • Navigating the new Directions:
    • Family Law Practice Direction – Financial proceedings
    • Family Law Practice Direction – Priority Property Pools under $500,000
  • Cost implications for parties and their advisers for parties who don’t conduct matters in a manner consistent with the FCFCOA’s purpose
  • When to consider the fast-track hearings list
  • What should you be changing now in your practice?

Session 2: Children and Parenting Matters in the FCFCOA

A key focus of the new FCFOCA is to ensure the safety of vulnerable parties and children. How this impacts the management of children and parenting matters in practice is the focus of the session, including:

  • Changes to Child Dispute Services and Family Consultants
  • Introduction of a new Child Impact Report for interim proceedings
  • Understanding the new Family Law Practice Direction – Parenting Proceedings
  • Genuine Steps Certificate – what does this require?
  • The role of the Lighthouse Project

Session 3:  Contravention Cases in Family Law: Holding Parties to Account

The highly anticipated new National Contravention List has now commenced. This practical session examines the issues that need to be considered when acting for the applicant or the respondent in such contravention applications, and the matters that the new FCFCOA will consider in determining applications. It covers:

  • Navigating the new Fam-Contravention List and the new Application Contravention Form
  • What are the new timeframes? 
  • What penalties or sanctions can be imposed where contravention has been proved?
  • What is, and is not, a reasonable excuse for non-compliance?
  • When will matters be triaged to dispute resolution?
