This session covers the requirements to use the GST free going concern treatment for property, as well as the implications of getting it wrong, including:

  • The basic requirements
  • How the GST free supply of a going concern provisions can apply to property transactions
  • What if the business and the business premises are sold under two separate contracts?
  • How the provisions can apply to a tenanted commercial building
  • The conditions to supply “all of the things necessary for the continued operation of the enterprise” where property involved:
  • What conditions are required if the vendor terminates the lease?
  • What if a tenancy at will is in place?
  • What if a periodic tenancy is in place?

Loretta Bishop-Spalding, Director, GST, Real Property, Australian Taxation Office, Adelaide, SA

Loretta Bishop-Spalding is the Real Property Risk and Strategy Director for GST in the Australian Taxation Office. Her role within the ATO includes leading the ATO consultation with industry and government on Build to Rent asset class. She is also responsible for management of the GST at Settlement regime and is the Risk Director for all things GST and Real Property, including the Margin Scheme. Prior to this role, Loretta was the Risk Director for the ATO’s management of the Cash and Hidden Economy. She facilitated key deliverables under the Black Economy program including the introduction of the ATO’s Mobile Strike teams and the implementation of the Electronic Sales Suppression legislation. Loretta is also a qualified property conveyancer and is studying her Masters in Property at Adelaide University.  


This webinar is suitable for accountants and lawyers advising on GST and property law – Australia wide. This webinar is for practitioners with some knowledge in this area and looking to improve their knowledge.
