 Misbehaving Agents under Powers of Attorney - Legal and Equitable Remedies for Elder Financial Abuse

The Australian Law Reform Commission in its recent report on elder abuse identified misuse of powers of attorney in a significant minority of elder abuse cases.  In this program, Darryl Browne, from Browne Linkenbagh Legal Services in the Blue Mountains, New South Wales, in the context of four recent Supreme Court decisions, identifies the legal and equitable remedies available against, not just the attorney, but also other parties, including third parties who have benefited from the attorney’s misbehaviour, and solicitors advising principals and attorneys.
