Challenging SMSF Trustee Discretion in Death Benefit Payments

Superannuation death benefits often are the largest asset that is available for distribution after the death of a testator. Where there is no valid binding death benefit nomination in place, it is at the trustee’s discretion as to how these benefits are paid out. This session reviews the exercise of a trustee’s discretion in making death benefit payments by reference to the case law and overriding obligations which a trustee is required to follow.
