 The Role of Equity in Family Law Matters

The Family Court has the ability to consider a range of equitable remedies in property settlement applications which may make a major difference to the division of property in a particular case.  In this program, Monique Robb, from Landers & Rogers in Sydney, provides a guide to the remedies available, and when they can be usefully sought in property settlement proceedings.  Remedies looked at include resulting and constructive trusts, undue influence and unconscionable conduct, proprietary equitable estoppel, the equity of exoneration, and subrogation.
