 Weighing Up the Evidence in Capacity Challenges

Testamentary capacity is often raised as a ground for challenging the validity of Wills, and the 150 year old seminal case, Banks and Goodfellow, continues to be applied by the Courts in assessing and dealing with such challenges.  In this program, Christian Teese, from Rigby Cooke Lawyers in Melbourne, through case studies, looks at how the courts weigh up conflicting evidence of testamentary capacity, best practice for solicitors in assessing the capacity of will-making clients, and the preparation and preservation of evidence of the client’s capacity to meet any challenge to the Will on those grounds.
