 Standing in the Company`s Shoes: Derivative Actions and the Court`s Inherent Jurisdiction

Derivative actions are a means whereby shareholders, and others, can apply to the Court to bring proceedings on behalf of a company, and applications for leave can be brought under the Corporations Act 2001, or in the Court’s inherent jurisdiction.  In this program, James d’Apice, from Chamberlains Law Firm in Sydney, reviews the statutory rules, and the inherent powers of powers of the Court, in relation to derivative actions in the light of the case law, and makes recommendations on the best approach when advising a client who wants to bring a derivative action.
