 Frustration and Force Majeure in Property Contracts (Victoria)

The COVID-19 pandemic, and the measures taken by the Government to control and supress it in Victoria, has highlighted the risks for parties to property contracts of such unexpected, far reaching, and continually changing events that alter the nature and effect of the property transaction.  In this program, Eva Vicic, from McCullough Robertson Lawyers in Sydney, looks at two possible avenues for parties to property contracts to vary, extend or ultimately terminate the contract in response to such circumstances: force majeure clauses and the doctrine of frustration.
