 The Right to Know: Disclosure Obligations in Wills and Estate Matters

A key obstacle to a person contemplating bringing an action to contest a Will, and/or the administration of a trust, is the ability to obtain information about such matters as the contents of the Will, the circumstances of the making of the Will, and whether they are beneficiaries of a Will or trust.  In this program, barrister John Armfield, from Second Floor Wentworth Chambers in Sydney, looks at the recent decisions of the courts in relation to disclosure in Wills and estate matters, including preliminary disclosure, in the context of the courts’ increased emphasis on case management.
