Costs have become a major issue in family law proceedings with the Family Law Rules adding a further layer of regulation on top of the various state and territory Legal Profession Act requirements.  In this program, Stephen Page, from Page Provan in Brisbane, looks at the legislation and rules affecting legal practitioners costs in family law proceedings, including: the basis of a family lawyer’s right to recover costs in the Federal Circuit and Family Court; the costs rules in the state and territory legislation; how costs are regulated under the current Family Law Rules; the approach of the Rules, and the Court, to making cost orders, including orders against solicitors; and the practical effect of this regulatory regime.
