Morning: Hardwiring Protections in the Estate Plan

The most integral component of any estate plan is arguably being able to hardwire mechanisms to protect client assets. In the morning sessions, learn directly from the experts on the best way to do exactly that. Practical sessions include how to utilise discretionary trusts for maximum impact, the use of mutual wills as an estate planning tool, and protecting super through the effective use of binding death benefit nominations.

  • Estate Planning and Discretionary Trusts: Maximising their Impact
    • The discretionary trust may be the main estate planning tool of choice, but not all trusts are created equal. They require careful planning and structuring.  This practical session examines the key strategies to consider when utilizing discretionary trusts in the estate plan.
  • Mutual Wills as an Estate Planning Tool
    • Mutual wills provide benefits for blended families. However, they also have their limitations. This practical session looks at the use of mutual wills as an estate planning tool.
  • Managing Binding Death Benefit Nominations in Estate Plans
    • Super will often be a client’s most significant asset. As a result, binding death benefit nominations can be an integral part of a client’s estate plan. This session looks at the key issues involved with making a bullet-proof BDBN.

Afternoon: Authority and Capacity Issues in the Estate Plan

The afternoon sessions examine the troublesome issues that can arise with capacity and authority issues in the estate plan and how they can be best navigated by practitioners and their clients. It includes sessions on estate planning when capacity is at issue, identifying and responding to an attorney who has potentially breached their obligations, as well as fraud on a power and how it may impact estate plans.

  • Estate Planning When Capacity is an Issue
    • When capacity is the issue, estate plans require careful management. This session examines how advisers can establish an estate planning framework to minimise the risk of incapacity by a key decision-maker, and what they should do if that happens without appropriate measures in place.
  • From Use to Abuse: Calling Your Attorney to Account
    • Enduring powers of attorney are an important tool for estate planners. However, the sad reality is, where there is power, there is potential for abuse. This session examines the options available when an attorney has potentially breached their obligations.
  • Fraud on a Power and the Power of Variation in Trusts
    • This session looks at the established trust principle of fraud on a power and how it may impact estate plans with an invalid exercise of trustee discretion.
