How can you tell your witness’s story in a way that helps them?  How do you decide what’s in and what’s out? This practical session ensures you draft your affidavits for clarity, simplicity and, most importantly, admissibility. It covers:

  • Planning an affidavit – what is its purpose?
  • Understanding the rules of evidence when drafting the affidavit:
    • what can and can’t you say?
    • properly identifying how the witness knows something
  • Tips and pitfalls when drafting:
    • establishing the witness’s credibility from the outset
    • setting the scene – but keeping it simple
    • capturing the voice of the witness in the drafting
  • Drafting differences between affidavits for final versus interlocutory hearings
  • Proper use of annexures and exhibits
  • When to use an index or table of contents
  • Drafting techniques that irritate judges

Marcus Hassall, Barrister, Canberra

Marcus Hassall is a barrister with more than 20 years’ advocacy experience whose career has involved appearing in a wide range of courts and tribunals Australia-wide.

Since being called to the Bar in 2011 Marcus has developed a diverse, multi-jurisdictional practice.  His areas of practice include: commercial disputes; administrative law; specialist in proceeds of crime litigation; criminal law (defence and prosecution); administrative law; family law; professional negligence; insolvency; inquests and numerous other areas.

Marcus is currently a member of the Criminal Law and Continuing Professional Development Subcommittees of the ACT Bar Council.  He is also a Commissioner with the ACT Legal Aid Commission.

Marcus has been a mentor with the Commercial Law component of the Australian National University’s Legal Workshop program since 2012. In this context he particularly focuses on corporations legislation and practice.
