Recorded Webinar: The Perils and Perks of the Casual Workforce in the Not for Profit Sector

13th November 2018

Duration:  approx. 90 minutes

NFPs have proportionally high casual workforces, with casual staff the backbone of many organisations. However, there are several issues that arise in relation to casual employment, with the recent Full Federal Court decision of Workpac Pty Ltd v Skene highlighting the costly risks for employers. This session unpacks this significant decision and how it impacts the NFP sector, including:

  • Defining casual employees – lessons from Workpac Pty Ltd v Skene [2018] FCAFC 131
  • Long term casual employees - rights and entitlements under the Fair Work Act
  • OHS issues involving casual staff and home care visits
  • Roll out of casual conversion clauses in modern awards that operate in the NFP sector:
    • when can a casual employee request permanent status?
    • processes required within the organization to consider the request
    • consultation requirements
    • grounds for refusal
  • Consequences for an organization if there is a shift from casual to permanent
  • Casual staff and entitlement to vote on enterprise agreements
