The move over the last five years to more streamlined technology and electronic procedures in conveyancing has been given a further boost and added dimension by an increase in remote working arrangements and new rules for conveyancing practice and procedure resulting from the Covid-19 fallout. Nevertheless, these changes have also increased transactional risks, and this session provides a guide to practitioners on how to factor in and minimise risks in the new normal, including:

  • PEXA procedures and responsibilities – how the system has changed the role of practitioners

  • A toolkit for what practitioners should consider when making certifications and statements
  • Tips and traps for electronic witnessing and signatures – the controls that need to be in place
  • Follow-up signatures, multiple documents and record-keeping – evidentiary and other requirements
  • Corporations law requirements and electronic signatures
  • The risks of a remote VOI regime and obligations of practitioners as identity agents – what are “reasonable steps”?
  • What should a diligent practitioner be doing – fraud and risk minimisation, using third party verifiers and management of potential liability.
