Date:  Recorded: 19 January 2022

Victorian laws have always been at the forefront of disclosure requirements compared to other states, but have been given an added boost in the last few years, particularly with the addition of the “material fact” disclosure obligations. This session will examine the new requirements, consider how to decide what’s in and what’s out and pitfalls conveyancer’s need to watch out for in making a disclosure including:

  • A discussion of the key elements of section 12(d) of the Sale of Land Act and the background to the recent amendments
  • Consumer Affairs Guidelines on s 12(d) – what is their authority and what reliance can a vendor place on them?
  • What does “knowingly” mean? What standard will be applied?
  • What is a “material fact” for the purposes of section 12(d)?
  • Consideration of potential disclosure issues and details to be provided in the disclosure
  • Cases and examples
