Responsibility for making a valid claim to a caveat has shifted from the client to the PEXA user as a result of process changes requiring conveyancers to make a certification. This session will provide a guide to the lodging of a caveat and how conveyancers can minimise their risks in doing so, including:

  • An overview of the law of caveats – what is a caveat and what does caveat registration do?
  • What constitutes a caveatable interest and when should one be lodged?
  • What are the consequences of improperly lodging a caveat?
  • How PEXA has changed practice: a study of the decision in Guirgis v JEA Developments Pty Ltd [2019] NSWSC 164 and its implications for:
  • The role of conveyancers in lodging caveats
  • The responsibility of conveyancers when lodging caveats

David Andrewartha, Senior Associate, MinterEllison, Melbourne

David works in the Real Estate team at MinterEllison advising on complex land law, subdivisions, acquisitions and dispositions, a range of commercial, industrial retail and off the plan development sites, crown land dealings, leasing, property disputes, carbon rights and statutory land acquisitions.  He has acted for developers, property owners and managers, owners corporations, mortgagees, universities and government entities. David also advises in multi-skilled, cross-practice teams on national and international corporate due diligence, acquisitions, land development, and complex infrastructure and construction projects.

Before becoming a lawyer David worked as an operational plantation supervisor in Gippsland, Victoria.  David also draws on 16 years' experience as an officer in the Australian Army Reserves in a wide range of appointments that complemented and broadened his professional skills.
