About the Webinar

The taxing principles of deceased estates and testamentary trusts (TTs) follow some of the guidelines that apply to other trusts. However, they also have their own quirks and complexities that practitioners need to be aware of. This session explores some of the issues that arise in practice when dealing with a deceased estate’s or a TT’s tax obligations, including:

  • The tax differences between a deceased estate and a TT
  • Who pays the tax – executor, trustee or beneficiary?
  • The taxing issues relating to the deceased’s main residence
  • The tax difference where an asset “passes” to a beneficiary in accordance with a will, or is transferred under a “power of sale”
  • Tax issues with:
    • introducing assets unrelated to the deceased person into a TT
    • a TT borrowing to acquire assets
  • Tax issues to address when:
    • the deceased is a resident however the executor, trustee or a beneficiary resides overseas
    • an inheritance is received from overseas (Sec. 99B ITAA 1936)
  • Practical examples
