About the Webinar

The small business CGT concessions are some of the most generous concessions available within the income tax legislation. However, with this generosity comes complexity and it is an ongoing challenge to keep abreast of how the concessions can apply in practice. This session is designed to highlight issues, tips and traps that can arise when applying the concessions in various situations, including:

  • When can property be an active asset if the entire property is not used for business purposes?
  • How to determine if an assets “main use” is to derive rent and why it matters
  • Can the concessions apply to the sale of property as part of a “residential letting business”
  • How shares in a company or interests in a trust can satisfy the active asset test, including:
    • the additional basic conditions that apply to shares and trust interests
    • the impact of excess cash on the balance sheet
  • How to determine if a CGT asset sold by a discretionary trust is eligible for the concessions
  • How the small business CGT concessions can assist with a business restructure
  • Practical examples

Edward works in the Business Law team at Sladen Legal, with a core focus on providing federal tax advice to small and medium businesses.

Edward commenced his career in the ATO’s Tax Counsel Network and Review and Dispute Resolution business lines.
