Rising property prices and the fear of missing out on entry into the real estate market have caused many Australian families to enter into off-the-plan contracts for their future (yet to be built) home. However, the delays experienced in building and construction since COVID coupled with rising interest rates, changes in market conditions (and in some cases personal circumstances) have left many buyers with a change of heart and seeking to get out of their contracts. While it can be difficult for a buyer to terminate an off-the-plan contract, in certain circumstances there may be grounds to do so. This session explores the key options and strategies available, including:

  • The grounds upon which a buyer may be able to terminate an off-the-plan contract, including:
    • misleading and deceptive conduct (by vendor and/or agent)
    • failure to disclose and/or changes/variation to the disclosure statement (and its increased significance in light of the new Property Law Act)
    • failure of developers to comply with construction sunset clauses.
  • What is required to successfully pursue each ground
  • What to do if you find yourself on the other side of such a claim
