As land becomes more expensive, younger generations in rural communities are looking for more creative and collaborative opportunities to generate income and get their foot in the door with agri-business. There can be a tendency for such ventures to be informal or for those involved to look to more traditional forms of business structures (including partnerships and joint ventures) for these collaborations. However, these decisions are often based on out of date legal advice or misconceptions and the business structure chosen by clients may not be the most appropriate vehicle for the business, which may only be realised once things turns sour. This session examines:
- Practical tips for helping you understand what your client is seeking to achieve with a proposed business venture
- Types of business structures and the advantages and disadvantages of each
- Focus on agricultural co-operatives:
- what they are and how they are structured
- the legal, accounting and governance requirements that must be met before being eligible for tax and other benefits
- Reviewing existing business structures and the secondary structures to make any joint ventures or other business structure work
