About the Webinar

Increasingly, members of a family are entering into informal arrangements to manage their ongoing relationships, whether it be for caring for the elderly parents or joint housing/living arrangements. The failure to seek legal advice or even reduce these agreements to writing has significant consequences for all parties, particularly when conflicts occur or after the death of a party. This session will examine recent cases and provide a guide to practitioners on assisting families to formalise their intentions, including:

  • A discussion of recent cases including Richardson v Lindsay [2019] NSWCA 148; Flourentz v Spink [2019] NSWCA 315; Wallis v Rudek [2020] NSWCA 207
  • The role of duress and undue influence in family arrangements
  • What remedies are available in such situations?
  • When will a constructive trust arise?
  • Role of practitioners in advising and drafting documented family agreements
  • Who is your client?
  • What safeguards should be included in the agreement?
  • Centrelink and other financial consequences
