Several years on, has this new process led to better outcomes for families? This session will examine the operation and outcomes of the NCL through a study of cases and examples, including:

  • The key objectives on establishment
  • The pro’s and con’s of the process
  • What has been the impact of the NCL rules on the bringing of contravention applications?
  • Are instances of serious non-compliance being appropriately dealt with?
  • What constitutes a reasonable excuse?
  • Are threatened costs orders modifying lawyer behaviour?
  • Are the remedies and orders of the Court achieving the desired practical outcomes for families?
  • Are contravention applications the best way to remedy ongoing compliance issues or are there more effective and less costly alternatives?

Senior Judicial Registrar, Federal Circuit and Family Court of Australia Brisbane, QLD

Prior to her recent appointment as Senior Judicial Registrar, Ann-Maree was a highly experienced barrister and had many years of experience as a mediator with national accreditation (NMAS). Ann-Maree is also a qualified arbitrator. She had a busy practice specialising in all aspects of family law including property and financial matters, parenting issues, spousal maintenance and de facto relationships.

Ann-Maree appeared extensively in courts in the family law jurisdiction, including at the appellate level, in complex parenting cases with issues of risk, relocation, mental health and special needs, and in property cases involving trust and company structures, valuation and tracing issues and third party interveners. Ann-Maree successfully took one of her cases to the High Court of Australia (see her article in Proctor, the interview with the Law Report on Radio National, and the Pathways presentation featured here re Clayton v Bant).
