The insolvency provisions of the Corporations Act 2001, have recently been amended with the stated aim of facilitating restructuring and recovery of insolvent companies. First, the insolvent trading provisions, from 18 September 2017, incorporate a “safe harbour” for directors; and second, “ipso facto” provisions will take effect on 1 July 2018, preventing termination of contracts after the occurrence of certain insolvency events.
