Binding the Financial Agreement

The financial agreement provisions in Family Law Act 1975, Part VIIIA, since they were originally enacted in 2000, have been subject of a number of amendments, and a growing body of case law all the way to the High Court. In this program, Justine Clark, from Tisher Liner FC Law in Melbourne, looks at the impact of the recent High Court decision in Thorne and Kennedy, and other recent cases, on the issue of when and if binding financial agreements are binding, and the issues that need to be considered in drafting financial agreements.
