As HR professionals are increasingly expected to act as in-house employment law experts, the risks of stepping into legal territory have never been greater. With rising penalties and expanded regulatory scrutiny, providing what seems like helpful “advice” could land HR in legal hot water—as an accessory to a contravention. This essential session provides HR professionals with the tools and strategies to draw clear boundaries between lawful support and unlawful legal advice—protecting both themselves and their organisations. It will:

  • Clarify the legislative framework around accessorial liability, including how courts distinguish between general HR support and the provision of legal advice
  • Use practical examples to demonstrate where HR professionals can inadvertently cross the line—and how to recognise the red flags early
  • Provide language and strategies to help HR practitioners push back diplomatically when management expectations are unrealistic or legally risky, without compromising their professional standing

Chris Molnar

A partner in Kennedys’ Melbourne office, Chris has been assisting clients to solve workplace relations problems for nearly 30 years.

He has extensive experience across all Australian jurisdictions. He has litigated in State courts and tribunals, and deals regularly with matters in the Federal Court and the Federal Circuit Court.

His clients include large ASX-listed companies and SME's, State, Federal and Territory governments, local councils and public-owned entities. He also acts for individuals, typically senior management. His practice, both litigious and non-litigious, includes employment law, discrimination law, sexual harassment, bullying, industrial relations, work, health and safety, directors’ liability and protection of confidential information.

Chris has post-graduate qualifications in law (LLM) and management (MBA) and regularly presents at industry and legal seminars. He is accredited by the Law Institute of Victoria as a specialist in workplace relations and is also a Fellow of the Australian Institute of Company Directors. He is a past member of the Specialisation Board of the Law of Victoria. He is currently the co-chair of the Workplace Relations Committee of the Law Institute of Victoria.

He is a regular contributor to the Law Institute Journal and was a speaker at Monash University’s Conference in Prato, Italy, in 2012 on Business Innovation and the Law.
