The ATO’s finalised rental property guidance is now in place — and the 2026/27 income year is the first year in which TR 2026/1, PCG 2026/2 and PCG 2026/3 will apply without the benefit of the ATO’s transitional compliance approach for pre-1 July 2026 expenses. With IT 2167 withdrawn and the ATO now applying a much sharper lens to holiday home deductions under s 26-50, accountants need to revisit how they prepare rental property returns for clients with mixed private and income-producing use. This session gives accountants the technical grounding and practical tools to navigate the new framework and prepare accurate, defensible returns for affected clients. It covers:

  • The finalised framework: what TR 2026/1, PCG 2026/2 and PCG 2026/3 actually say, how the finalised guidance differs from the drafts, and what replaced 40 years of IT 2167
  • The leisure facility trap: when s 26-50 can deny deductions for holding and capital costs entirely, including interest, council rates, insurance, land tax, body corporate fees and capital works deductions
  • The “mainly income-producing” test in practice: why day-counting alone no longer works and how the ATO now assesses purpose, behaviour and commercial intent
  • Green, amber and red: applying the PCG 2026/3 risk framework to your client portfolio, including the records and evidence needed to support a defensible position
