Property duties and taxes are a constantly moving feast in NSW, resulting in audit activity catching out unsuspecting landowners. In this fireside chat, learn directly from the experts on the recent developments impacting property transactions in NSW. Potential topics to be discussed include:

  • Choosing between stamp duty, land tax and the annual property tax
  • Eligibility requirements for the annual property tax (which it is proposed will be limited to first home buyers only)
  • The introduction of duty on certain transactions that result in a change in beneficial ownership, including:
  • how the change applies for an option to purchase land
  • if an option is not exercised, can a refund of duty be obtained?
  • whether duty on a grant of an option is credited towards duty payable when the option is exercised?
  • When can an “acknowledgement of trust” be a dutiable event in NSW, including:
  • what documents have an accountant’s input that could inadvertently trigger the duty? (ie. trustee minutes?)
  • whether the rules have an impact on deceased or life estates
  • When can duty rules trigger a “double duty” trap?
  • recent NSW duty amendments
