Session 1: The Role of the Central Practice Direction in the FCFCOA
The newly commenced FCFCOA is accompanied by a Central Practice Direction for the family law jurisdiction. This session takes a deep dive into the CPD and its practical implications for family lawyers, including:
- Understanding the role and scope of the CPD
- CPD core principles which practitioners must know and apply
- Managing cost risk for non-compliance to CPD
- Understanding the case management Pathway under the CPD
- Worked examples and lessons learnt in practice
Session 2: Understanding and Preparing for Dispute Resolution in the FCFCOA
What does mediation look like in the new court system and how should you best prepare for it? This session covers the main issues, including:
- When an unresolved matter may be directed to dispute resolution
- The dispute resolution process in the case management system
- Recognizing importance of dispute resolution in CPD requirements
- The external and internal dispute resolution process
- Preparing for the dispute resolution process – planning the strategy
- Court rules for dispute resolution including mediation
- Tips and tricks for mediation preparation in different scenarios
Session 3: Appeal Processes in the FCFCOA
This session looks at the key procedural requirements for appeals and how to best prepare for them. It includes:
- Court structure for appeals – the new FLAD of the Federal Court
- Notice of Appeal and service requirements – Rule 13.03
- Requirements for Notice of Contention – Rule 13.08
- Procedural orders court can make on the appeal – Rule 13.13
- Appeals to the Full Court – Rules 13.15 – 13.23
- Some procedural and evidential matters relating to Full Court appeals
- Reviewing decisions of judicial registrars
- Cost applications in appeal matters
- What matters cannot be subject to appeals?
