Whether planned or not, the family farm often ends up getting passed down the generations through an inter vivos family agreement or as the result of a divorce or death of the primary farmer. Each of these scenarios carry with it particular tax consequences and considerations which need to be factored in when dealing with the event and for future succession planning. This session shall:

  • Explore the taxation implications of when the family farm is passed down in each of these three scenarios;
  • Discuss using recent case examples what to do (and what to avoid if at all possible) in each scenario
  • Guide lawyers through the steps that can be taken in advance to protect against unforeseen and unintended tax consequences
