Session 1: Legal Ethics: Keeping the House Clean: Navigating Ethical Issues in Property Law
Property law can be furtive ground for ethical issues. This practical session will step through a number of hypothetical scenarios to illustrate the ethical challenges that can arise in private practice. It covers case studies involving the following key issues:
- Verification of identity
- Who is your client?
- Representing multiple interests in a transaction
- Rebates
Session 2: Professional Skills: Acting on Urgent Caveat Instructions: Stop, think and think again
There are times when a practitioner receives an urgent request from a client, such as to lodge a caveat. Acting before taking a number of important steps can get practitioners into serious trouble. This session will explore how to effectively and successfully respond to the receipt of urgent instructions, including:
- How the move to electronic dealings has resulted in greater pressure on practitioners
- Shifting the risk – practitioner assessments and verifying statements
- Does your client have a valid claim? Case study: Guirgis v JEA Developments Pty Ltd [2019] NSWSC 164
- The role of the “guardian at the gate” – what a practitioner needs to know before lodging a caveat and making representations
- Consequences for practitioners, including costs orders and disciplinary action.
Session 3: Practice Management Business Skills: Cyber Security: Building Resilience in your Property Law Practice
Cyber risk is a growing area of professional risk for all lawyers. However, property law practices, which hold sensitive information and act on high value matters such as property transfers, can be especially vulnerable. Do you have the appropriate procedures to prevent a cyber incident or recognise an email scam? This session arms you with the right skills, including:
- Recognising the human aspects of cyber risk
- Establishing risk reduction measures
- New insurance options to consider
- A breach has occurred – what next?
- establishing a response action plan
- who needs to be notified?
- what are your professional obligations?
- crisis assistance – what is available?
