In these situations, a well-managed, mutually agreed separation can minimise disruption, preserve dignity, and reduce legal and reputational risk.This session offers HR professionals a strategic guide to facilitating low-conflict exits with clarity, compliance and compassion. It will:

  • Outline how to prepare internally for an agreed separation, including what information should be gathered, documented, and presented before involving legal counsel;
  • Explore the legal mechanisms that can support a clean exit—such as without prejudice discussions, settlement offers, and deeds of release—along with the risks and limitations of each
  • Provide guidance on communication strategy throughout the process, from informal “fireside chats” to formal correspondence—tailoring messaging to the audience and desired outcome while maintaining procedural fairness and protecting the organisation.

Amaya handles cases in multiple jurisdictions, including the Federal Court of Australia, the Federal Circuit Court of Australia, and several tribunals like the Fair Work Commission and the Victorian Civil and Administrative Tribunal.

Her expertise covers advising on and representing employers in unfair dismissal, general protections, anti-bullying, discrimination claims, and managing complex industrial disputes. Amaya is known for her practical advice, risk mitigation, and efficient claim management. She has significant experience in retail sector disputes, handling everything from individual dismissal claims to large-scale litigation. This experience makes her skilled in both advisory roles and advocacy during mediations, conciliations, and contested hearings.

Amaya also has a strong interest in the education sector, advising on state and federal discrimination complaints, abuse claims, faculty performance management, and general legal advice. She effectively balances a robust defence with the supportive approach necessary in a school setting.

She holds a Bachelor of Laws and a Bachelor of Arts in History from Monash University and was admitted to practice on 17 October 2017.
