This session explores some of the issues, including:

  • Why determining tax residency is not always straightforward
  • The tax implications that can arise if the estate plan includes: 
    • a non-resident executor or beneficiary
    • a non-resident trustee of a testamentary trust
    • a deceased person residing overseas with assets in Australia and vice versa 
  • The CGT event K3 tax distortion where the tax burden may fall where not intended to
  • Taxing issues with non-residents receiving capital gains from discretionary, including testamentary, trusts (TD 2022/13) 
  • The process of taxing non-resident distributions from a deceased estate or a testamentary trust
  • Strategies for dealing with non-resident status in the estate plan
