  • Determining the date of insolvency and how this may be proved or justified;
  • The duties of directors, position of ASIC and issues surrounding knowledge of the liquidator regarding director’s behaviour and actions;
  • Potential defences available to directors pursuant to s588H and the approach of the court in relation to these;
  • The consequences of insolvent trading; and
  • The role of the liquidator in recovering against the director/s

Alicia heads Sladen Legal’s Dispute Resolution and Litigation team.
