The use that a property is put to can change over the course of its ownership. A long-term vision for the property can turn into a short-term sale, or an initial intention to develop and sell may turn into a long-term rental-yielding investment. Whatever the change in purpose or intention, being mindful of the GST impact of such a change should be front of mind. This session explores the GST implications when a change of intention occurs, including:

  • When can a change in a property's use trigger GST adjustments?
  • GST implications if uncertainty as to whether a residential property will be constructed for lease or sale (GSTR 2009/4)
  • GST implications when developing residential property with:
    • the intention to sell, however the market dictates that leasing may be a more prudent course of action
    • the intention of leasing, however, an offer to sell is received that is too good to turn down
  • GST implications of satisfying 5 years of leasing newly constructed residential premises, whilst also marketing for sale during that period (Domestic Property Developments Pty Ltd as trustee for the Dals Property Trust v C of T [2022] AATA 4436)

Neil Brydges
Principal Lawyer, Sladen Legal Melbourne, Vic

Neil Brydges is a Principal Lawyer in Sladen Legal’s tax group. Neil practises in all areas of direct and indirect tax with a particular focus on the taxation of trusts, deceased estates, income and capital gains tax, and Division 7A.

Neil has also advised extensively on cross border taxation issues and the implications of transactions and dealings in the development of property. Using his technical tax knowledge, Neil works with clients to obtain commercial and practical outcomes. He has particular experience in dealing with the Australian Taxation Office on complex tax issues in a dispute resolution context.

Neil is a keen and active member of the tax community. As well as presenting on tax topics at various sessions, he has authored and co-authored several published articles, papers, and bulletins. Neil is a member of the Tax Committee of the Law Council of Australia, an Accredited Specialist in Taxation Law and is a member of the Tax & Revenue Law Committee with the Law Institute of Victoria and a Chartered Tax Advisor and member of the Dispute Resolution Technical Committees with The Tax Institute.
