Partly due to the current cost of housing proving to be an ever-increasing challenge for many, “early inheritances” are becoming a common scenario for passing wealth to the next generation. This session drills down on whether tax can be a factor in determining whether to commit to an early inheritance as an option, or whether it may be more tax-effective in the long run to let the estate plan run its course, including:

  • The tax pros and cons of selling assets and gifting proceeds to family members pre or post death, or transferring assets directly, for:
    • listed shares
    • investment properties
    • the family home
    • the family farm
  • Tax issues to consider if closing down the family trust pre or post death of the matriarch or patriarch
  • Tax comparisons of a superannuation death benefit versus a pre-death withdrawal and gift to the family
  • Can the small business CGT concessions be more beneficially utilised pre-death?
  • Do the state and territory taxes and duties differentiate between property transferred to family members pre or post death?
  • Tax tips and traps when considering paying an early inheritance
  • Case studies comparing tax implications of an early inheritance strategy versus a legacy received in accordance with a will from:
