Amanda has published articles on trusts, tax and the importance of estate planning, business succession and asset protection. Amanda has extensive legal knowledge and experience as a lawyer for over 30 years having practised with law firms in the Melbourne CBD for over 25 years but also with a Ringwood firm and Slaughter and May in London. For the first approximately 10 years of her legal career, Amanda practised as a commercial litigator appearing in the Supreme Court and Federal Court and instructed in London in cases before the High Court and on an appeal to the Privy Council. For over 20 years, Amanda has practised in commercial law, trusts, tax, asset protection and the importance of estate planning including appearances before the Supreme Court, Family Court and VCAT (Guardianship List) in disputes about control of family wealth in trusts and companies.

The increasing complexities of the world are not lost on the challenges that can arise when dealing with family dynamics and the family unit. This session explores the impact on family law matters when trusts are part of the estate plan, including:
- How exposed are the assets in an inter-vivos or testamentary trust when a family provision claim surfaces?
- Can a trust be an effective structure to use in the estate plan to protect the surviving spouse's use of the main residence?
- Dealing with pre-existing binding financial agreements, the death of a spouse, and if a planned or existing trust has any impact?
- Does the choice of who is to control the trust after the death of a parent have an effect on family law issues that may surface, including:
- whether one child or a number of siblings take control
- where control is left to a professional trustee
- Does it make a difference to family law matters if a trust is set up pre-death or initiated in a will?
- If trusts are used as part of the estate plan, can family law issues be more prevalent if the class of beneficiaries is wider or narrower? (Owies v JJE Nominees Pty Ltd [2022] VSCA 142)
- Strategies where trusts can be used:
- to benefit both a surviving spouse and children from either the current or a past relationship
